Mixed Messages for Gay Community: Federal Judge Places Temporary Ban On Dont Ask Dont Tell But White House is Appealing Gay Marriage Ruling

Its good news and bad news for Gay Americans on Tuesday. First a Federal Judge has made the ban of Don’t Ask and Don’t Tell policy on Homosexuals in the US Armed Forces. US Federal Court Judge U.S. District Judge Virginia Phillips in Riverside, Calif., ruling to stop investigations and Court Martial against Gay service members.  From Wall Street Journal:

A federal judge ordered the military to stop enforcing the “don’t ask, don’t tell” law that has been used to discharge gay service members, putting at least a temporary halt to the 17-year-old policy.

Tuesday’s order by U.S. District Judge Virginia Phillips in Riverside, Calif., applies across the U.S. and would halt proceedings against service members suspected of violating the policy, which aims to bar openly gay people from the military.

The Obama Administration must decide to follow the Judges order or appeal it. The timing  cuts close to the November 3rd midterm elections.

Meanwhile  The White House is appealing the Gay Marriage Ruling. From Reuters:

The Obama administration filed a notice of appeal with the U.S. District Court for the District of Massachusetts in support of the 1996 Defense of Marriage Act, or DOMA, that barred gay marriages, even though Obama had previously opposed the law.

Although Obama opposes the law, a Justice Department spokeswoman said that the administration was defending the statute because it was obligated to defend federal laws when challenged in court.

“As a policy matter, the President has made clear that he believes DOMA is discriminatory and should be repealed,” said Justice Department spokeswoman Tracy Schmaler. “The Justice Department is defending the statute, as it traditionally does when acts of Congress are challenged.”

Many in the Gay community frustrated with the administration’s double talk; are  not  happy. Homosexuals activists protested the president in Florida on Monday. First President Clinton now President Obama.
Exit Question: Will gays will come out (no pun intended) to vote in three weeks only time will tell.
