California Give Homosexuals Another Victory Don’t Ask Don’t Tell Ruled Unconstitutional

An US Federal Court Judge in Riverside.CA  ruled the military’s on gays and lesbians prohibition of serving openly better known as Don’t as don’t tell is unconstitutional.

FromThe Daily Caller: US District Court Judge Virginia A. Phillips says the DADT doesn’t not affect combat readiness contrary to what Justice Department attorneys and many supporters have argued, because evidence shows that the policy in fact has had a “direct and deleterious effect” on the armed services.

Phillips said she would issue an injunction barring the government from enforcing the policy. However, the Justice Department, which defended “don’t ask, don’t tell” during a two-week trial in Riverside, will have an opportunity to appeal that decision.

H/T: LA Times has the rest of the story.
The only thing bothers me is the fact US military is now in country  in nations that are not friendly to Gays and Lesbians  like Iraq, Kuwait and Saudi Arabia.  I would be concerned that those that who are outside of the battlefield are with partners( or not ) are discovered (or captured off the streets) and they reveal as gay could be arrested, punished or kill for being out.
So I hope Pentagon would find a way to protect homosexuals in these locals because this a dangerous situation.
