US Federal Court Finds California’s Propostion 8 Unconstitutional

US Federal District Court Judge finds California’s Proposition 8 unconstitutional.  From LA Times:

US Federal District Court Judge Vaughn Walker stated that saying that no legitimate state interest justified treating gay and lesbian couples differently from others and that “moral disapproval” was not enough to save the voter-passed Proposition 8.

Judge Walker said that in California  “has no interest in differentiating between same-sex and opposite-sex unions,” U.S. District Chief Judge Vaughn R. Walker said in his 136-page ruling.

The ruling was the first to struck down a local version of Defense of Marriage Act a/k/ a DOMA.

Both Sides will be gearing up for additional battles supporters will appeal to higher courts.

Walker said the law violates the equal protection under the law due process.

The Judge allow the a stay until Friday.
